California Lease Requirements: Opt Out of Internet-Related Subscription Services

California Civil Code § 1942.8 gives residential tenants the right to opt out of third-party services offered with a tenancy.

For all tenancies beginning, renewing, or continuing month-to-month after January 1, 2026, tenants must be given the option of opting out of third-party subscriptions or bulk billing deals that provide internet, satellite, or cellular services.

Tenants who opt out will not be billed for services. If the tenant is billed, the tenant may deduct the billed amount from rent.

Landlords may not retaliate against tenants for opting out, nor may the landlord assess any penalties, hidden fees, or rent markups to tenants who opt out.

To ensure compliance with this new California landlord-tenant law, Landlords should attach this document to their California Lease Agreement.

• California Notice of Belief of Abandonment: If a Tenant has missed at least 14 days of rent and you believe they have abandoned the property, this notice must be sent to Tenants.
• California Unlawful Detainer Complaint: This is the complaint Landlords use to officially initiate eviction proceedings. This can be used when a Tenant has violated the Lease Agreement and been served proper notice.
