Oregon Smoking Policy

Under Oregon law, the Lease Agreement must include a disclosure of the Property’s Smoking Policy. This disclosure must clearly state whether:

  • Smoking is prohibited on the entire Property.
  • Smoking is allowed on the entire Property.
  • Smoking is allowed in limited areas on the Property. If this is the case, the disclosure must clearly identify the areas where smoking is prohibited.

Can Landlords prohibit smoking on the entire Property?

Yes, it is legal for Oregon Landlords to prohibit smoking on their property. Smoking is not protected under local, state, or federal fair housing laws, and Landlords can create their own rules restricting it.

What state laws should Landlords consider when creating their Smoking Policy?

There are two state smoking laws that are relevant for rental properties and that Landlords should consider when creating their smoking policy:

  1. Oregon law prohibits smoking in all indoor common areas and in any location where an employee must go as part of their job - for example, a rental office.
  2. Doorways, windows, vents, and air intakes must be smoke-free within 10 feet of a building in Oregon.
