Ending and Renewing Fixed-Term Lease: Notice is not required for Lease termination and the Tenant shall vacate the premises unless otherwise specified in the Lease Agreement.

Month-to-Month Lease: Written notice must be given at least 10 days prior to the expiration of the current month.
Security Deposit There is no limit placed on the security deposit charged to the Tenant as long as it is reasonable.
Returned Payment Fee Returned payment fees may not exceed $25 or 5% of the face amount, whichever is greater. Any such fees must be specified in the Lease Agreement.
Late Fee Late fees should remain reasonable and related to the Landlord's actual expenses incurred.
Insurance Requirements Landlords may require Tenants to obtain renters insurance, and could make the failure to do so a breach of the Lease Contract.
Notice to Enter Landlords are not required to give notice, however, it’s always recommended to give at least 24 hours’ notice before entering Leased premises.
Landlord Requirements SUBLEASING There are no stated regulations forcing a landlord to accept a sub-lease arrangement.

Contact your local housing or zoning office to ensure your rental property complies with city and county requirements for inspections, rent control, occupancy limits, property codes, and zoning. Many cities and counties require inspections or registrations and have specific maintenance regulations.

Required Disclosures

Louisiana does not have any state-specific disclosures that must be included in the Lease Agreement.

  • Lead-Based Paint Disclosure: Pursuant to federal law, if a rental unit was built before 1978, occupants must be provided with a lead-based paint disclosure.

Do Lease Agreements need to be notarized in Louisiana?

No, Lease Agreements do not have to be notarized in Louisiana. If both the Landlord, or lessor, and Tenant, or lessee, sign the Lease Agreement it’s legally binding. If the parties want to have the contract notarized they can, but this isn’t required.

Are written Lease Agreements required in Louisiana?

According to Louisiana law, Lease Agreements may be written or oral. That said, we highly recommend always having a written Lease Agreement. This is vital for ensuring that you and your rental property are fully protected.

Anyone who rents real estate - whether it’s an apartment, duplex, single-family home, or condo - should have a written Lease Agreement in place before handing over possession of your property to renters.

How do you write a simple Lease Agreement?

A simple Lease Agreement covers the basic terms of the rental relationship. This includes the name of the Landlord and Tenant, the Lease term, the rent amount, late fee policies, and security deposit amount.

There are some basic, generic Lease Agreements available online, but if you start with one of these, make sure that it’s state-specific. The Louisiana Association of Realtors offers a blank, fillable standard Lease form. However, this does not provide the complete protection that Louisiana Landlords need. Instead, you need a customizable Lease that covers all aspects of your rental property.
