Disclosure of Death on Property

California Civil Code § 1710.2 requires Landlords to disclose to prospective Tenants any death that has occurred on the rental property premises within the past three (3) years. This information must be disclosed to Tenants prior to entering into a Lease Agreement and should be documented in writing as part of the Lease Agreement.

Note: Landlords are not required to disclose a death that occurred more than three (3) years ago or if a previous occupant died from AIDS-related complications.
