Ending and Renewing |
Fixed-term Lease (most common): There is no minimum or maximum time restriction for notice required for Lease termination or renewal, except that terms of notice shall be clearly defined in the Lease. Month-to-month Leases and Leases with no set end date: Landlords must provide 60 days notice to end the Lease. Tenants may end Lease with 30 days notice. |

There is no limit placed on the security deposit charged to the Tenant, so long as it is reasonable.

Contact your local housing or zoning office to be sure your rental property complies with city and county requirements for inspections, rent control, occupancy limits, property codes and zoning. Many cities and counties require inspections, registrations and have specific maintenance regulations.
Required Disclosures
Georgia law requires that the below disclosures are included in the Lease Agreement.

- Lead-Based Paint Disclosure: Pursuant to federal law, if a rental property was built before 1978, the Landlord must provide Tenants with a Lead-Based Paint Disclosure and Lead-Based Paint EPA Pamphlet.
- Flood Disclosure: If the rental property has been damaged by flooding at least three times in the last five years, the Landlord must notify the Tenants in writing of the property’s susceptibility to flooding.
- Identification: Landlords must notify Tenants of all managers, individuals or agents that are allowed on the property. Ga Code § 44-7-3.
- Move-in/Move-Out Inspection Form: Upon accepting a security deposit, Landlords must give a list of any damage to the property. Ga Code § 44-7-33. Pro Tip: Our Move-In/Move-Out Checklist is an EZ way to do this and to provide thorough documentation of property condition.

Does a Lease Agreement need to be notarized in Georgia?
No. The Rental Contract just needs to be signed by both the Landlord and Tenant to be legally binding.
How long can a Residential Lease be in Georgia?
The standard Lease term in Georgia is one year. However, longer Lease terms are allowed as long as it’s clearly stated in the Lease Agreement and both parties agree to the longer term.
You can also have shorter Lease periods - for example, Month-to-Month, a Short-Term Lease, or a Vacation Lease.
While one year is standard, parties can agree on the Lease term that works for them and then specify that in the Lease Agreement.
What is a Lease Agreement?
A Lease Agreement - sometimes referred to as a Rental Contract or Rental Agreement - creates a contractual relationship between a Landlord, or lessor, and a Tenant, or lessee. The Lease outlines all terms of the Leasing arrangement including Lease term, rent amount, and any additional fees or deposits.
A basic Lease - for example, the one offered by the Georgia Association of Realtors - provides blank spaces for Landlords to fill in this key information. A more thorough Lease covers all rules, terms, and policies and is customized to the unique requirements of each rental property.
