Ending and Renewing Week-to-Week: 7 days' notice is required. Month-to-Month: 30 days' notice is required. Fixed-Term: No additional notice is required other than what is contained in the written Lease Agreement. If nothing is specified in the Lease, termination is automatic at the end of the Lease term.
Security Deposit There is no limit placed on the maximum amount a Landlord may collect for the security deposit.
Returned Payment Fee The returned check fee can not exceed $30.00.
Late Fee There is no limit placed on the amount that can be charged for a late fee; however, assessed fees should be reasonably related to the Landlord's expenses as a result of late payment.
Insurance Requirements Landlords may require tenants to obtain rental insurance and could make the failure to do so a breach of the Lease Agreement.
Notice to Enter Landlords must provide at least 24 hours' notice before entering the leased premises.
Landlord Requirements The Landlord must disclose to the Tenant the names and addresses of the owner or any agents who are authorized to act on the owner’s behalf in writing, before or at the beginning of the tenancy.

Subleases require the written consent of the Landlord.

Many cities and counties require inspections and/or registrations and have specific maintenance regulations.

Does a Lease need to be notarized in South Carolina?

No, South Carolina Rental Contracts do not need to be notarized. As long as the Lease is signed by both parties, it’s considered fully executed and legally binding. The parties can opt to have the Lease notarized if they’d like to, but it’s not required.

Do South Carolina Lease Agreements need to be in writing?

In most cases, both verbal and written contracts are enforceable in South Carolina. HOWEVER, we highly recommend that you always use a written contract.
