Texas has a new statute requiring Landlords to disclose flood risks that applies to all Lease Agreements entered into on January 1, 2022, or later. It does not impact Lease Agreements signed prior to January 1, 2022.
The statute requires that Landlords disclose:
- If the rental property is in a 100-year flood plain, as defined by the Federal Emergency Management Agency (FEMA).
- If the property has flooded within the past 5 years.
