Alaska Eviction Procedures: Writ of Assistance
To file an eviction in Alaska, Landlords must first issue proper Notice:
- Alaska 7-Day Notice to Quit: Use this notice when Tenants have unpaid rent.
- Alaska 10-Day Notice to Cure or Vacate: Use this notice for Lease violations other than nonpayment of rent.
At the end of the Notice period, if the Tenant has not complied with the Notice, the Landlord may initiate eviction proceedings by filing a Complaint for Forcible Entry and Detainer. Once the Complaint is filed, the Landlord must serve a Summons and the Complaint to the Tenant at least two days before the eviction hearing is scheduled.
If the Landlord is successful in the eviction hearing, the judge will issue a Judgment of Possession, which sets the date by which the Tenant, now the Defendant, must be out of the property. If the Tenant does not vacate the property by this date, the Landlord may use a Writ of Assistance to have the Tenant removed by a Peace Officer.
Tips for Using the Alaska Writ of Assistance
- If you are worried that a Tenant will not vacate the property, you should have the judge complete this form at the eviction hearing.
- The Landlord should fill in the caption, description, and location of the dwelling on the Writ of Assistance. The court will complete the rest.
- Once the date to vacate the property has passed, the Landlord should take the Writ of Assistance to the relevant Peace Officer. This is usually the sheriff, but you can check with your local clerk’s office to determine who to contact.
- Many jurisdictions charge a fee for the execution of a Writ of Assistance.
