Using Nebraska 3 Day Demand For Rent

When a tenant has not paid their rent, they can be given the 3 Day Demand For Rent notice. This form can only be used in the case of non-payment of rent and may not be used for any other kind of lease violation. The form gives the name of the tenant, the address of the property, the amount of rent owed, the date the notice was delivered, the name of the landlord and the conditions of compliance.

How It Works

The landlord needs to provide this notice to the tenant in a way that proves the date of receipt since the deadline is so strict. This means that the best method for delivering the notice is by hand personally to the tenant. It can also be served by:

  • Mail,
  • Certified mail
  • Posted at the leased property,
  • Hand delivered to another resident at the property.

Once this form has been delivered to the tenant, they will have three days to comply with the demands that have been laid out in the notice. They are required to pay the total owed amount of rent to the landlord by cash, cashier’s checks or money order. These forms of payment ensure the tenant has the money and it will be in the hands of the landlord by the deadline rather than having a fraudulent check.

Failing To Pay

If a tenant does not have the money to provide the payment or does not comply for any reason then the landlord can begin the formal legal processes for the return of the premises to the landlord. If this happens then the tenant is responsible for not only paying the amount of rent that is due but also for any damages, the costs and attorney fees and the rent that the landlord would have been collecting in the time of the hearing.
