The Tenant Protection Act will become effective on January 1, 2020, and will remain in effect through January 1, 2030. Note that the rent cap provisions retroactively apply to rent increases from March 15, 2019.

A residential landlord shall not, over a one-year period, increase the “gross rental rate” more than (a) 5% plus the percentage change in the cost of living or (b) 10%, whichever is lower.

Exempt properties include:

1. Residential real properties subject to local rent control and the rental rate is less than the rent limitation.

2. Housing that has been issued a certificate of occupancy within the previous 15 years

3. Single family homes that are not owned by a real estate investment trust, a corporation or a limited liability company that has one corporate member. Owner must give tenant written notice stating the unit is exempt.

4. A two-unit building in which one of the units is occupied by an owner as the owner’s principal residence

Notice to End/Renew Lease: You must provide the following notice to renew or not renew:

  • Month to Month: A 30 day advance written notice is required for leases that are month to month and/or under 1 year.
  • Leases for 1 Year or More: 60 days advance written notice is required.

Have the perfect tenant, and want to keep them after the lease terms expires?

Easy! Just sign this Lease Renewal Agreement with them, and you're all set. To make the process even easier, the agreement is editable in case you want to tweak any other terms of the lease agreement too.

State and province laws differ on how far in advance landlords must notify renters that they may renew (or must vacate), so be sure to mail this agreement with enough time to spare. (See the State Assist information on this page for local tips, and feel free to view our State Rental Law Summaries too.)

More Details:

Use this form to extend legally all the terms of the existing contract for an additional lease period. This useful and friendly lease renewal form notifies the tenant that their lease is due to expire soon and that the landlord would like to provide the tenant with the opportunity to renew their current lease agreement. It includes a section for the tenant to fill out and return in order to indicate approval of the continuation and states that the lease will be extended automatically if no reply is received. This is an extra measure of security for the landlord.

The landlord can print this form as-is, or add their own custom text into the form. The ezLandlordForms Lease Renewal Agreement includes the proper language for continuing a lease and allows a landlord to include any special stipulations, terms, rules, regulations or anything else that comes to mind. It is very important that the landlord takes notice of their state laws in addition to the current lease for when and how a notice of renewal must be sent in addition to the specific number of days. Once the landlord serves the notice of renewal, the tenant may choose between the option to accept or decline the renewal. It is completely up to the landlord to either create a new lease agreement entirely or use this agreement as the renewal agreement.
