California Lease Requirements: Security Deposit Electronic Return & Communication

As of January 1, 2026, California landlords have new requirements regarding the return of the security deposit. California Civil Code § 1950.5 and AB 414 provide that:

  • If a landlord collects a security deposit electronically, it must be returned electronically unless the parties agree to another method in writing.
  • The landlord may send itemized deductions and other related communications via email if both parties agree to this method of communication in writing.
  • If there are multiple tenants, any returned portions of the security deposit must be paid by a single check to all tenants unless the parties agree, in writing, to a different method of distribution.
  • If there are multiple tenants, the itemized list of deductions may be sent to one tenant selected by the landlord unless the parties agree, in writing, to a different method of communication.

The California Security Deposit Return & Electronic Communication Addendum allows landlords and tenants to:

  • Designate a method for the return of the security deposit
  • Authorize electronic delivery of an itemized statement and other related communications pursuant to California law
  • Designate the allocation of the security deposit when there are multiple tenants
  • Designate communication methods when there are multiple tenants
  • Provide tenant contact information and forwarding addresses
