My tenant in Arizona is now 16 days late with the 3rd months rent! I included a $25.00 per day late fee after the 5 day grace peroid, is this ok? And should I include the late fee accural in the demand for rent letter?

Hello: There are no stated limits to how much you can charge for a late fee or whether or not you may charge a per day late fee in AZ. It would ultimately be up to the judge. Often a judge will use what he/she thinks is reasonable. In some courts $25 per day may be considered a bit much. When sending your 5 Day notice the landlord may demand payment of an amount of money in the five day notice letter that includes the past due rent and any penalties or late charges that are authorized in the lease between the landlord and the tenant.
