I have a tenant who is late on his rent. We drove by and all his furniture is gone except for a lamp and table in the window. How long do I have to wait to enter the premises? He had until today (August 1st) to have rent and late fees paid.

Often times it’s best to look for the obvious, such as removal of personal goods, whether or not the tenant has come back to the premises at any time during a one week period, and simply no food in the refrigerator or utilties that are shuht off. It’s extremely important to document all of the “proof” gathered in order to determine abandonment. You can ask the neighbors if they have seen moving trucks and such. When in doubt, if payment of rent has not been made, the landlord may always file for eviction.
