My tenant has not paid rent for 4 months in a row. On the lease it states that if you fail to pay rent for 2 months in a 12 month calendar year you default on the lease agreement.
I sent him a notice to vacate the property in 10 days unless he pays the remaining balance owe, he may remain in the property. He adondoned the property and did not tell me when he was leaving.
Question: Did I need to serve him an eviction notice to remove him from the property? Even though he breached the lease agreement? Is the written notice legal to remove him from the property. I am pursuing small claims court.

If he abondoned the apartment but left all the keys and you have a withness to this you should be ok.. If no key was given to you then you need to go thru the process and get them legally evicted from your house or you can be sued for illegally ..eviction.. This happen to me in march..
