Ouch! Do a search on google for demand payment and rent and see what forms come up. Why haven't you gone to start an eviction process yet?

That's just cause for evicting. In CA it's a 60 day notice if they have lived there longer than 1 year, before that it's 30, check your state. Give notice, wait the notice period, then file an unlawful detainer, they have 5 days to respond, if they don't, get a writ of possession and they can be out within 6 days, if they respond, request a court trial asap.
