That is a phrase of dispute everywhere! It means different things to different people, therefore meaning different things to different judges. Basically wear and tear is damage that will inevitably occurs as during regular or normal use. Therefore, usually the need to paint is not considered damage BUT if there are severe damages like large holes in the walls, staining and writing; this can be contrued as beyond normal wear and tear. ALWAYS take pics BEFORE your tenant moves in and when the tenant moves out and USE an inspection report.
