Landlord Question and Answer Forum
I have filed an eviction complaint against my tenants for not paying rent. Our court date is set, but they are making partial payments. They make payments by depositing money directly into my bank account. Since the eviction was filed, they've made two partial deposits. I am certainly happy to receive whatever money they are paying, but I still want them out if they cannot catch-up entirely by our court date. Can their payments effect my case in any way?

RE: Partial payments when eviction in progress
Check with your local jurisdiction. The court where you filed for the eviction should be able to give you this information. In some states, accepting a partial payment can stop the eviction yet in other states it has no effect at all.

RE: Partial payments when eviction in progress
This is a question to be determined on an individual case basis. I would agree with the above posting and add that in most of the cases, a partial payment has little impact.
