hello,
i have a tenant that has receive a letter in the mail with my name on it; stating the house they are renting is in forclosure; I haven't receive any notification from the bank the house forclosure procedings has been place; therefore I haven't notified tenant to vacate premises; contact tenant for rent for the month; refuse all calls; until today; call came from someone that's not a tenant stating tenant would be vacating the premises this weekend and not paying any rent and proceding with lawyer.
I would like to know if I have the right to take papers out for non payment of rent and breaking the lease.

Is your mortgage current or are you waiting for foreclosure proceedings to begin?

Not an attorney but... until the bank takes the house back and has title you are still the owner of the property regardless if you are behind in your payments. Check your state laws to start the eviction process now.
