I have an oral lease w/ tenant. In mid July I asked her to leave for nonpaymt of rent effective 8/1 and clean place since no deposit given. Tenant says not moving; is this grounds to file eviction based on holding over property..Also, can I ask for past rents?

Non-payment of rent is ground enough for eviction. I would follow the guildelines in your state for eviction for non-payment of rent or contact an attorney the sooner the better.
