Month to month lease has anyone ever heard of a tennant winning a case when the eviction for no cause was properly served because of a tennant was not wanting to move .

I have never heard of a landlord losing a case where they were evicting a tenant because they refused to move once the lease expired. That said, make sure you've given them all the appropriate notices informing them that their lease was not going to be renewed, and that they must vacate.
