Landlord Question and Answer Forum
I'm obviously new to this-- please help. I'm taking over management of our rental and drawing up a lease. I am not the legal owner of this property (my husband is). Do I put my name down as the landlord or his? Also, do I have checks made out to myself or to him? We have a shared bank account and are married, but I am unsure of the legal issues with this.
Does anyone know?

I would say you were the property manager, Landlord is defined as the owner of a rental property.

The checks/money orders etc. would be made out to the owner/company etc. which in this case is your husband. The tenant has contracted/signed for the lease term and therefore no rent/deposit is refunded.
