Landlord Question and Answer Forum
My assistant sent out a renewal notice with the incorrect rent amount($1000 less than the $2000 that was supposed to be charged) The tenant replied and signed the renewal. I caught the mistake before the lease was created. I explained the error that was made but the tenant said they are taking me to court and that I should have to pay the $1000 a month difference. Is this not just a notice? I thought the lease was the contract not the notices that we send.

RE: Property Management
The renewal notice depending on how it was written may be an extension of the lease, there for the form that was signed is the new lease term. Now if it is a lease renewal and you were going to raise rent 1000.00 a month is steep and may be against the law. Usually there is a percentage of the full rent that the rent increase can be. If you are in the right however an can prove it you may need to start with eviction proceedings.
