Is not finding a apartment as good as what they had for the same amount of money considered a hardship case , in other words I gave these people a good deal for a long time and they are saying they cannot find a place they can afford .

Being a landlord is bitter sweet.
When you go to court, tell the judge to haven't received any calls of reference, therefor your tenant will have the burden of proving to the court that they have been actively searching.
