Very new to rental properties... bought a home with tenants in the home. Previous owner has no application, or lease agreement. Tenant does not want to sign a new lease with me or fill out rental application. What do I do? I am worried that if something happens to the tenant (death) I have no idea who to allow in the home to get contents. Also, if nothing is filled out what can I do if the tenant does happen to pass? I pray this does not happen... Just want to protect myself, and the tenant. TIA

If they choose not to enter a rental agreement with you, send them notice to end the tenancy. Usually that is 30 day. Since they have no lease, once their tenancy expires, you can go to court to evict them as holdover tenants.

Yup - Leah has it right. Note that in some states, if you are in a 'verbal' M2M contract, the notice doesn't always have to be 30 days. In Colorado for example, the default required notice in this situation would be 10 days.
