If you reject ANYONE who has a criminal record, then yes, being deaf has nothing to do with it. In fact you are treating him just like any other applicant.

To avoid problems in the future, you should reject his application. Always screen the tenant before renting out an apartment. I am using tenant screening services from Tropicana Realty, they check criminal record, credit history and previous eviction of tenants.
