Landlord Question and Answer Forum
If I contract with a NH RE agent to arrange a RENTAL of my private, single-family home, is that agent obligated (either by their code of conduct/ethics or their fiduciary responsibilities) to "vet or qualify" a prospective renter by conducting a Criminal Background Check and disclosing the results to me - before the agent agrees to renting on my behalf - especially if the prospective tenant is a convicted felon and ALSO a registered sex offender?

RE: NH Real Estate agent fiduciary and disclosure obligations
They are responsible for the tenant and who they choose as the tenant solely. Make sure that you have an agent agreement written up to make sure they know what their responsibilities are and that they are held responsible for the tenant, damages and money that the tenant causes or has not paid. This is the purpose of the agent.
