I have evicted tenants in September 2011 w/ a 3 day signed noticed to pay or leave notice. they signed but didn't removed all property...what process do I need to legalize that i now have posession of said property. They never answered my calls and property is still there. Can I now sell the property or keep it. Left numerpus messages Carmen.Wiggins@comcast.net

A sheriff may remove a tenant's personal property when executing a writ of restitution. A landlord has no duty to store or inventory the property, or to determine its condition or ownership. If he elects to do so, he may charge the tenant for reasonable storage costs.
