new pet abd late paymnet of rent

I have a tenant who continually pays m late or partially every month. They are in the second year of a 2 year lease w payments due of-the 15th of the month. They have paid 800 of the 2200.00 due for feb and now are 5 days late on the balance 1400.00 . Can i still file a 3 day pay or quit on the balance. Is e mailing that notice acceptable by law?
