In Virginia, is the eviction process the same whether there is a lease or not? My tenant has been without a lease since November. He has not signed a new lease. Since we are month-to-month and he has been weeks late paying the rent since November, what procedure should I take to evict?

yes but it is a little more difficult. The procedures are the same, i would give a sufficient amount of notice to terminate. Do your research too, very important.

The old lease should indicate that it will continue on a month to month basis. If it does you have a lease its the old one just on month to month.
