Landlord Question and Answer Forum
If I have written in my lease that said lease will terminate 2 days after payment is due and not paid. Can I retain the total deposit even if the deposit is more than rent owed? Provided I have stated this in the lease.

RE: Security deposit and termination of lease due to "Lack of or Late Payment"
Why would you keep more than the total of the rent? The only time you can withhold the deposit for more that what is due is if there are damages that exceed the total amount of the security deposit and if you do that please make sure that there is proof of damages.
