I'm in upstate New York. Thee lease on this tenant expired 1 year ago - we've been month to month since then. She is over 2 months behind in her rent and has caused damage to the property. I did receive 1/2 a months rent on 3-1, can we start eviction proceedings for non payment of rent with a 3 day notice?

The issue is with accepting partial rent. Note that if you start an eviction and accept partial rent, then you have to start the eviction process over again.
