How can I request a tenant who is not working out to vacate. I sent them a new lease and it has not been signed, can I send an amended lease for month to month?

If the tenant is not working out, I would not send them a new lease to sign. Is there any lease signed? Are they due to vacate? I am guessing you didnt sign the new lease you sent over? Do you have a reason to have them vacate... ie late rent, illegal activity... etc? If so, you would want to move forward with an eviction vs signing a month to month lease.
