I have a rental that has one spouse who is active in the militarty for a few months at a time - we may have to give them their notice to move out so we can move back in as our primary home. Is there a law stating I cannot send a notice since in the military or they may become active again when I send the notice? I will be giving a 60day notice.

Military is treated as any other tenant. A 60 Day Notice is required if they live at the property for at least 12 months. No reason is required, by it helps to understand why you’re asking them to move. -----Disclaimer: Since I’ve been answering a lot of questions, I thought I would make the following statement.
