I have a live in couple who have decided to split. The father who is also living there has decided he and his daughter will continue to live in the house(boyfriend has moved out). Am I obligated to give boyfriend back his deposit(he paid) and require a new deposit from existing tenants? I have started paperwork to remove him and add father to the existing contract.

RE: Keeping security deposit
I like to stay out of the security deposit issue as much as possible. I would have the new tenant give the old tenant his share of the security deposit. I would have the old tenant and all the other tenants sign that they are willing to release the old tenant from the lease and then you can create a new lease with the new tenants on the lease and start fresh.
