We have a tenant that moved into our property in the middle of the month. He paid the prorated portion for that month, gave us a check for the deposit (bounced). This was in June 2011, it is now the middle of August. Tenant has filed chapter 13 and will not leave. The courts have said that we can't make him move because of his filing chapter 13. We have a trial date coming up, which I'm hoping the judge will let us get our property back. This tenant works for a company called "self help legal docs", which makes him know the legal system. We were told we could file a motion for relief of stay, don't know how to go about that.

Get an attorney!! A tenant filing a bancruptcy can be a nightmare. An experienced attorney can make things go smoother and quicker.
