Hi there, I would really appreciate an answer:
On the first of the month rent is due from one of our Section 8 tenants. An "eviction hold" is in place with Sec. 8 at our request. Naturally, he is pushing us to accept deliquent rent for June and his rent for July. He will be getting his 30 day notice from us, dated July 1, on a month to month lease. If the tenant sends a rent payment (in the form of a money order) by UPS and we do not cash the check and return the uncashed check...is the rent for for July considered "accepted" in housing court.

RE: 30 day eviction to take possession of property due to lease violation
I believe that does not count as "accepted" rent. You can refuse to accept payment in that method.
