I apologize in advance for this may be a lengthy question. Im in Long Beach, CA and I own a house that I made the mistake of letting someone stay with me on a week to week basis, no lease since I thought this would only be a week or two stay. She is the only person beside myself that live in the house and she does not have her own room, meaning, I have access to her room any time I wish, she also does not have a key to any lock in the house. It has now been six months and she is still here, way beyond her welcome. I have asked her to leave and she refuses to go.
Now, as I believe, under Civil Code 1946.5 she is a lodger and I dont need a court order to have her removed, only a written, week long, notice to leave. Is this correct?
