We have a month to month lease agreement with a couple who are not married and both on the lease. She want him out and wants to continue to rent. She is the bread winner and has paid for everything. We have asked them both to give 30 Days notice. What if he does not move out when he finds out she is going to stay?

I'm confused. You state that you've served BOTH parties with a 30 day vacate but one is staying?

Have you given them notice or did you ask them to give you notice? Give them notice and sign a new lease with her. If he doesn't move evict him.
