My tenant has been late with their rent 2 out of the 3 months they lived there and they refuse to pay the late fees that are on the lease they signed. Can I evict if they pay after the grace period of 5 days written on the lease?

You can evict for the reason that they refuse to pay late fees (violation of signed lease). Typically, you need to post a "Five day remit or vacate" on their door, certified mail or in person (I always have them served by the county sheriff - then re-coup the fee from the tenant). They can pay after the issued five day period but if you want to evict, DO NOT ACCEPT IT. Instead, on day 6, go to the county courthouse and file for eviction.
