Landlord Question and Answer Forum
We have a tenant who was arrested and being charged with 8 felonies and is in jail. We don’t know yet if he will be getting out but he has broken the lease with these criminal charges. How do we go about evicting him when he’s in jail? We are in Minnesota.

In your lease if you add the "zero tolerance for criminal activity" this will breach the lease if any criminal activity occurs. So the leased premises is then in your possession again. Make sure you read through your lease agreement, this will determine a lot of the outcome.
