I am separated from my husband and we own rental property. I have a PPO against him so he is unable to come onto the property. Our tenant lives on the property as well. The home is a duplex. Our tenant has paid me the rent for the last 8 months but my husband and his lawyer called the tenant to inform him that he is violating the lease if he doesn't pay my husband instead. If the tenant decides to pay my husband instead in November I won't know. On the 2nd of the month can I start the eviction process?

This situation is not fair for the tenant because they are paying their rent, but because you and your husband are going through a separation you are causing stress on the tenants. As long as the tenants are paying their rent and following the rules then there should be no eviction.
