we gave tenant 45 days notice .
Refusing to move for additional 2 weeks stating his new apartment is not ready.
Any measures we can take ? BTW: Rental is NY

I wouldn't waste money and time with an eviction if they just need two more weeks. I would just let them stay for the two weeks and have them pay partial rent for the time they will be staying.
