My tenant has a month to month rental agreement. I serve her with a 60 day notice to vacate because I want to move back in my house. Now that I serve her a 60 days notice I am afraid she will not pay rent.Rent was due the 3rd of every month, she is late 3 days. I read that I should go to court to start the paperwork, what paperwork am I suppose to file with the court? Is there anything else I need to file.

I would get an attorney involved to make sure you have everything correctly. Also there is a section on this website that gives you the eviction process in a step by step guide, look for that, it has helped me. Every state can be so different with evictions, so make sure you are looking at the correct information.
