A tenant on month to month decided to move out without giving a 30 day notice is there a penalty for this? It took over 30 days to re-rent the place. They chose to move on their own. They paid through end of December so need to get the 35 day notice out to them.

They are responsible for the rent until the end of the term or until you rerent the place. So if they paid in December and you didn't get a tenant until February, then you would charge them rent from January also.
