I have a "roomer" tenant (renting a room in the house I reside in), renting under an oral month to month lease. Tenant has been served with 30 day termination of lease papers, but has made it clear that they are not going to be leaving at the end of the term. If the tenant has not vacated as of the 1st, Is my next step to serve an eviction notice?

YES! Serve an eviction notice immediately. Also contact your court and submit your service of notice paper work and get the eviction process started on the court end.
