Landlord Question and Answer Forum
Our tenant is on a month to month rental. Rent is due on the 1st of each month. Last night the 16th of the month we receive a 30 day notice from her. She states in her notice that she will give us half the rent on the 1st and will be leaving on the 16th. It seems somewhat goofy to me that she can give notice in the middle of a month and use the rent we already received from the month before to cover her 30 day notice...Make any sense?

This cannot actually be done they are required by law to give the full month rent or 30 days notice. If they are trying to skip out send them a notice they are required for the full months rent because they failed to give a 30 day s notice, and you will be perusing court action for the remainder of the money that they do not pay. Usually this will help make the tenant pay without a fuss.
