Hi I had tenants move in in May 2015 then July2015 they notified me that they are moving as of 8/31/15 they signed a 1 year lease but I did not have a early termination addendum. I was able to rent the home and have only 5 days of rent not being covered, ,my question is - do I still have to return their deposit or can I use that to pay those 5 days and return the balance to them? Yes, you can only deduct the amount of time that was lost for not having the unit rented and for any repairs beyond normal wear and tear that they caused. So any remainder of the deposit must be returned.
