I served a 3 Day Notice to Perform or Quit to tenant, in which they refused to sign. Im serving a notice to vacate today, IS this the right form to send before eviction process?

Yes this sounds right but make sure you have the proper number of days to vacate for that notice that is compliant with your state or city regs. Also you would want to file an eviction form with the court so that you can take this to court action if needed and there is no wasted time to hold the process up.
