During the first 3 months of the tenant's lease, multiple damages occurred and we are still trying to get the property management company involved in doing a true walk through to assess all the damages. It has now been 5 months since we first found out about the damages. The tenants are also smoking in the garage. "Smoking is not permitted in the house" is what is stated in the lease. They were also late one month for rent at the beginning of their lease. Is this enough information to evict them or should the property management company be held liable for their actions by not upholding their duties to us the landlords?

Yes you can evict them immediately, make sure to gather all proof of the breach and send the proper notices to perform or quit. Then file the eviction with the court Take note of damages and the receipt or estimate from contractors for repairs.

If they come up with all money that is owed for rent and damages, the judge will let them stay. But that's all you want anyways.
