I have a tenant whose lease expired in 2012 and he went on month to month. He has not paid rent since June 2014. I served my tenant with a notice to vacate effective August 31, 2014. My tenant expressed to me on August 15th that he was not going to pay rent and would not be departing my property. Has anyone had the experience of exercising their notice to vacate right? I want to know if I can legally put my tenant out of home on Sept 1st.

Yes you can but you must file an official eviction with the court to do so even in a month to month. You need to do this as soon as possible and send the tenant a notice of eviction and that it has been filed with the court. This in its own may be enough to scare them out.
